What is this Privacy Policy for?<\/h2>\n

This Privacy Policy aims to provide transparency about the processing of personal data carried out by WReis Advogados. Here we explain how we collect and store this data and for what purposes we use it. We also inform you that, in some cases, data may be shared with third parties; however, we will always comply with the Brazilian General Data Protection Law (\u201cLGPD\u201d), the privacy governance best practices recommended by regulators and technical and professional associations and, above all, our commitment to transparency, honoring the trust placed in WReis Advogados.<\/p>\n

Definitions<\/h2>\n

For a better understanding of this document, it is important to present some definitions set out in the General Data Protection Law \u2013 LGPD:<\/p>\n

(i) Personal data:<\/strong> information relating to an identified or identifiable natural person, that is, any data that allows, even indirectly, the identification of the individual to whom it belongs;
\n(ii) Sensitive personal data:<\/strong> personal data on racial or ethnic origin, religious belief, political opinion, membership of a trade union or of a religious, philosophical or political organization; data concerning health or sex life, genetic or biometric data, when linked to a natural person;

\n(iv) Processing:<\/strong> any operation carried out with personal data, such as collection, production, receipt, classification, use, access, reproduction, transmission, distribution, processing, filing, storage, deletion, evaluation or control of information, modification, communication, transfer, dissemination or extraction;
\n(v) Controller:<\/strong> a natural or legal person, under public or private law, responsible for decisions regarding the processing of personal data;
\n(vi) Processor:<\/strong> a natural or legal person, under public or private law, who processes personal data on behalf of the controller; and
\n(vii) Data Protection Officer (DPO):<\/strong> the person appointed by WReis Advogados to act as the communication channel, who can be contacted at contato@wreisadvogados.com, to handle internal requests and those from our clients regarding the processing of personal data, as well as those that may come from the Brazilian National Data Protection Authority (\u201cANPD\u201d).<\/p>\n

Whose personal data do we process?<\/h2>\n

We collect and process only the personal data that is strictly necessary and appropriate to achieve a legitimate purpose, above all to provide the contracted services.<\/p>\n

        Legal basis for processing your personal data<\/h2>\n

        If you would like to know more about the purposes indicated above, the legislation that allows and governs this processing is Law 13,709\/2018, the General Data Protection Law, and the purposes mentioned are supported by the following legal bases:<\/p>\n

        • compliance with a legal or regulatory obligation (item II of article 7);<\/li>\n
        • legitimate interest (item IX of article 7);<\/li>\n
        • consent (item I of articles 7 and 14);<\/li>\n
        • regular exercise of rights in judicial, administrative or arbitration proceedings (item VI of article 7).<\/li>\n<\/ul>\n

          We respect your rights<\/h2>\n

          In accordance with article 18 of the General Data Protection Law, we guarantee you, as data subjects, the following rights:<\/p>\n

          (i) You may confirm with WReis Advogados whether your personal data is being processed and obtain access to it at any time;
          \n(ii) If your data is incomplete, inaccurate or out of date, you may request that WReis Advogados correct it;
          \n(iii) You may also request the anonymization, blocking or deletion of unnecessary or excessive data, or data processed in breach of the General Data Protection Law;
          \n(iv) You may request information about the public and private entities with which WReis Advogados has shared data;
          \n(v) You may request the deletion of your data collected and stored by WReis Advogados, provided that the minimum legal retention period has elapsed;
          \n(vi) Data portability to another service provider will also be made available upon request; and
          \n(vii) Whenever WReis Advogados requests your consent to collect any data, you may ask about the possibility of not giving consent and its consequences. If given, you may later revoke your consent and request the deletion of that data.<\/p>\n

          We process the data collected for as long as the contractual relationship lasts, for as long as the original purpose lasts, or for the period required by any applicable legislation due to legal and regulatory obligations.<\/p>\n

            Hiring suppliers and third parties<\/h2>\n

            Suppliers and third parties with whom WReis Advogados has relationships, and who need to process personal data as a result, are required to comply with the guidelines set out in this Policy.<\/p>\n

            Since the protection of personal data is a collective commitment, WReis Advogados expects all of its partners to be aware of their responsibilities as data processing agents and, therefore, to have a minimum structure that ensures the protection of personal data.<\/p>\n

            It must also be ensured that personal data is stored in secure repositories, using techniques and tools that guarantee the integrity and security of information. Once its purpose has been fulfilled, personal data provided by the company must be disposed of immediately, and its use for purposes other than those previously established is not permitted.<\/p>\n

            All business partners of WReis Advogados, including suppliers, third parties and service providers, must have processes in place to ensure the security of personal information and to respond to data subjects\u2019 requests.<\/p>\n

            Where personal data is processed jointly, WReis Advogados may request the cooperation of third parties and provide the information needed to respond to data subjects\u2019 requests. If these partners receive a request directly from data subjects, they must notify the Data Protection Officer (DPO) within 2 (two) business days at contato@wreisadvogados.com.<\/p>\n

            Improper processing of personal data, or processing that does not comply with the law, may lead to termination of the contract and liability for the infringements committed, as provided for in the LGPD.<\/p>\n

            Finally, WReis Advogados may carry out audits to assess the security level of third parties and suppliers and whether they meet the minimum requirements set by the company. If they do not, they will be given a period to adapt and, if they still fail to meet the minimum standards, the service agreement may be terminated for cause.<\/p>\n

            Our responsibility<\/h2>\n

            As the processing agent of the personal data described above, we are responsible for keeping it secure, processing it within the limits communicated to you and ensuring that third parties only access it in the cases provided for herein.<\/p>\n
